Privacy Notice for Local Plan Consultations and Planning Policy Activities

This Privacy Notice explains how the Peak District National Park Authority processes your personal information when carrying out Local Plan and planning policy functions.

This notice should be read alongside the Authority’s Corporate Privacy Notice and any other service-specific privacy notices.

The preparation of Local Plans and other planning policy documents is governed by planning legislation and associated regulations, which require consultation with residents, landowners, businesses, statutory consultees and other interested parties. As part of these activities, the Authority may collect and process personal information.

Who We Are

The Peak District National Park Authority is the data controller for the personal information collected through Local Plan and planning policy activities.

We are registered with the ICO: Registration reference Z7027992

What Personal Information We Collect

We may collect and process the following information:

  • Name
  • Postal address
  • Email address
  • Telephone number
  • Organisation or company details
  • Agent or representative details
  • Responses, comments and representations submitted during consultations
  • Land ownership and site promotion information
  • Information submitted as part of evidence-gathering exercises, including Call for Sites processes
  • Records of correspondence relating to planning policy matters

This information may be provided directly by you, your organisation, or an authorised representative acting on your behalf.

How We Obtain Your Information

Your information may be obtained through:

  • Comments submitted on Local Plan consultations
  • Representations on planning policy documents
  • Local Plan consultation portals and online engagement platforms
  • Call for Sites submissions
  • Neighbourhood planning processes
  • Requests to receive planning policy updates or newsletters
  • Public meetings, workshops and engagement events
  • Correspondence sent to the Planning Policy Team

In addition, we maintain information on consultees as detailed in our Statement of Community Involvement.

Why We Process Your Information

We process personal information in order to:

  • Prepare, review and monitor the Local Plan and associated planning policy documents
  • Conduct statutory consultations and public engagement activities
  • Consider and analyse comments received during consultations
  • Notify interested parties of future consultation stages
  • Maintain consultation databases
  • Assess sites submitted through Call for Sites or similar exercises
  • Produce evidence and reports to support plan-making
  • Meet legal obligations relating to planning policy and local plan preparation

Lawful Basis for Processing

We process your personal information under Article 6 of the UK General Data Protection Regulation (UK GDPR):

Article 6(1)(c) – Legal Obligation

Processing is necessary for compliance with legal obligations placed on the Authority as the Local Planning Authority.

Article 6(1)(e) – Public Task

Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council.

Where you subscribe to planning policy updates or newsletters, processing may also rely on your consent, which you can withdraw at any time.

Publication of Consultation Responses

The Local Plan process is intended to be open and transparent.

Comments and representations submitted during consultations may be published as part of the public consultation process and may be made available for public inspection.

When responses are published, the Authority will generally publish the respondent's name and organisation (where applicable) but will seek to remove personal contact details such as:

  • Home addresses
  • Telephone numbers
  • Personal email addresses
  • Signatures

Who We Share Information With

We may share information with:

  • The Planning Inspectorate
  • Government departments and statutory consultees
  • Neighbourhood planning bodies
  • Professional advisers acting on the Council's behalf
  • Software providers supporting consultation platforms
  • Other Council services where necessary to fulfil statutory functions

Information will only be shared where there is a lawful basis to do so.

How Long We Keep Information

Representations linked to plan-making will be retained for no more than 7 years.

Your Rights

Under UK GDPR, you may have the right to:

  • Access your personal information
  • Request rectification of inaccurate information
  • Request erasure in certain circumstances
  • Restrict processing in certain circumstances
  • Object to processing carried out under a public task
  • Lodge a complaint with the Information Commissioner's Office (ICO)

Please note that some rights may be limited where information is required for the Authority to fulfil its statutory planning functions.
